General conditions for the use of the website

1. General Provisions

1.1 This document contains the conditions governing the use of this website (www.italiandatacenter.com) (hereinafter referred to as the ‘Site’) by users (hereinafter referred to as the ‘Conditions of Use’ ).

1.2 Use of the Site implies full acceptance of the Terms of Use by the user and the obligation to observe them while browsing.

2. Information on the Site Manager

The Site is managed by “IDA – ASSOCIAZIONE ITALIANA COSTRUTTORI & OPERATORI DI DATA CENTERS”, hereinafter referred to as the Association, CF: 97937060156 with registered office in Milan (MI) 20121, via Turati 29

3. Access and registration

3.1 Access to and navigation on the Site are free of charge. However, the Association reserves the right to restrict access to certain areas of the Site in favour of Registered Users, as better defined in point 3.2 below.
3.2 Users may register on the Site by creating a personal account (hereinafter, ‘Registered Users’). In order to register, users must read the privacy policy published on the Site and fill in the appropriate online form.
3.3 When registering, the user shall provide true, accurate, up-to-date and complete data and undertakes to update them in the event of subsequent changes. After registration, the user shall carefully guard his/her personal account access credentials (email and password) and shall not share them with third parties. The Association will not be liable in any way for any prejudice suffered by the Registered User resulting from unauthorised access to the personal account, loss of credentials or other activities carried out with the Registered User’s data. The Registered User shall also promptly notify the Association of any unauthorised use of his/her access credentials or of the reserved area. In this case, the Association may take the necessary measures to prevent the continuation of the unauthorised use of the reserved area.
3.4 If the Registered User violates the Terms of Use, the Association will be entitled to delete or block the Registered User’s account.
3.5 The Registered User has the right to withdraw freely and at any time from registration on the Site. In order to exercise this right, the Registered User shall send a written communication to one of the addresses indicated in Article 11 below, explaining the request. The Association will then proceed to deactivate/delete the personal account.

4. Privacy

Personal data provided by you through use of the Site will be processed in accordance with the privacy policy and cookie policy posted on the Site. The user is required to carefully read the aforementioned privacy policy and cookie policy before browsing and using the Site.

5. .Intellectual and Industrial Property

5.1 All texts, documents, contents, whether downloadable or not from the Site, all trademarks, names, distinctive signs, logos, images (hereinafter, “Protected Materials”) remain the exclusive property of the Association or its licensors/third parties and are protected by the laws on intellectual and industrial property.
5.2 You may not in any way or for any purpose reproduce, publish, disseminate, transmit, make available to the public, distribute, remove, delete, add to, modify, copy, sell, transfer or in any other way use the Protected Material. You are not granted any right or licence in relation to the Protected Materials. The Association reserves the right to take any legal action against you to enforce its rights to the Protected Material. Furthermore, the user indemnifies and holds harmless the Association from any liability, claim, action or prejudice of third parties in relation to the violation of their intellectual or industrial property rights committed by the user.

6. Other obligations of users

Users of the Site undertake to fully comply with these Conditions of Use of the Site. Users also undertake not to make improper or undue use of the Site and not to damage or impair, in any way or to any extent, the operation, usability and integrity of the Site and its contents. The Association reserves the right to take any legal action against the user for any conduct that violates the user’s obligations under the Terms of Use. Furthermore, the user indemnifies and holds the Association harmless from any liability, claim, action or prejudice of third parties in connection with the violation of the Terms of Use of the Site.

7. Liability

7.1 The contents of the Site are published without any guarantee of any kind, explicit or implicit. Although the Contents provided are deemed to be adequate and up-to-date, the Association does not guarantee that inaccuracies, errors and/or omissions may occur in any case, or that the Contents will not be promptly updated. The Association shall not be liable to users or third parties for any loss or damage that may arise directly or indirectly from the use (or inability to use) of the Site or from any of the information or content published on the Site. The Association reserves the right to modify and update the contents of the Site at any time.
7.2 The Association reserves the right to temporarily suspend the operation of the Site without notice. The Association does not, under any circumstances, provide any guarantee in relation to possible interruptions or slowdowns in the operation of the Site or in relation to its protection from computer attacks, and is therefore not liable for any damage or loss that users may suffer as a result of such events.

8. Links to other sites

The Site may contain links to other third party websites. The Association has no control over such websites and is not responsible for the accessibility or security of such websites or their contents, and cannot be held liable for any damage or loss resulting from the access or use of such third-party websites by users.

9. Changes

The Association reserves the right to make changes to these Terms of Use at any time. Changes will be effective as soon as they are published on the Site.

10. Applicable Law and Jurisdictione

10.1 These Terms of Use are governed by Italian law.
10.2 Any dispute relating to the validity, interpretation or execution of the Conditions of Use, or related thereto, shall be submitted to the exclusive jurisdiction of the Court of Milan.
